Definitions

Owner – The jacekdudzic.pl website is owned by: IMAGO Jacek Dudzic, ul. Obornicka 38/4, 02-953 Warsaw, Tax ID (NIP): 7120062088.
Educational Website – a virtual website available at jacekdudzic.pl
Operator – the operator of the services provided through the website is IMAGO Jacek Dudzic
Registration Form – a form that must be completed during the registration process for the educational website jacekdudzic.pl
Password – a string of characters used to log in to the system
Username – Username (in the case of jacekdudzic.pl – this is any name chosen by the user during the account creation process)
User – a person using the resources of the jacekdudzic.pl
website Login – the process of gaining access to online resources after the user’s
identity has been verified Registered User – a person who has registered in the system
Consumer – a customer who purchases goods for purposes unrelated to their business or professional activities

I. General Provisions

Acceptance of the following terms and conditions is a prerequisite for using the jacekdudzic.pl website and for each instance of using the courses.

A user of the website may be a natural person who is at least 18 years of age and has full legal capacity, as well as business entities and other entities.

The agreement for the provision of services related to the creation and maintenance of an account in the jacekdudzic.pl Store is concluded upon the Customer’s completion of the registration form, after accepting these Terms and Conditions, consenting to the Seller’s processing of personal data, and confirming the intention to create an account by clicking the “Create Account” icon. Before registering an account, the Customer should carefully review the content of these Terms and Conditions. The Customer may delete their account from the Store at any time and without providing a reason. Deleting the Customer’s account results in the termination of the agreement for the provision of services to make an individual account available to the Customer in the Store. II. Type and Scope of Services Provided

§1

These Terms and Conditions set forth the rules governing the operation of the informational and educational website. The process of using the website is personalized. Access to the information and educational materials offered is monitored and assigned to a single User name.

§2

The jacekdudzic.pl website is used to order and showcase collectible vinyl records, as well as informational and educational materials, and to promote them. Use of the website’s resources is entirely voluntary.

§3

The operator reserves the right to voluntarily change prices, the display of exchange rates and educational materials, add digital products, remove digital products, and launch and terminate promotions.

§4

Orders for products and services may be placed 24 hours a day, 7 days a week, year-round, except during technical and maintenance downtime.

§5

The store accepts orders via the form available on the jacekdudzic.pl website as follows: after selecting the desired product and clicking on its price, the customer adds it to the “shopping cart,” and then, after clicking the “Order” button, is automatically redirected to the order form.

§6

After placing an order, the Customer receives an email confirming receipt of the order. The confirmation includes a list of the products ordered by the Customer, their unit prices, the total price, shipping costs, as well as the delivery method and estimated delivery time. In the case of courses and virtual products, they become available immediately after the payment is processed.

§7

The basic condition for order fulfillment is that the Customer correctly completes the order form. In the event of any ambiguities regarding the submitted data, the store reserves the right to suspend order fulfillment. The Customer will be immediately informed of the situation.

§8

If the expected order fulfillment time is extended, the Customer will be notified immediately and will decide how to proceed (e.g., extend the waiting period, cancel the order).

III. Terms of Use

§1

Courses, information packages, and related services are available to interested individuals in both paid and free versions. For free courses and materials, access is unlimited. For paid courses, information packages, and related services, access is granted upon payment of the fee.

§2

Paid courses and services become available to the User once the payment is credited to the account.

§3

The User’s acceptance of these Terms and Conditions constitutes consent to receive commercial communications, as defined by the Act on the Provision of Electronic Services, at the email address provided by the User (Journal of Laws No. 144, item 1204).

§4

The User consents to the processing of their personal data in accordance with the Act on the Protection of Personal Data (Journal of Laws No. 133, item 883).

§5

The website operator assumes no liability for any damages incurred or that may be incurred if false or incomplete data is provided.

§6

The website operator may disclose personal data to third parties if necessary to provide services, as well as in cases where it is necessary to provide information to law enforcement authorities.

§7

Information is processed in accordance with the law.

§8

In accordance with the Act on the Provision of Electronic Services (Journal of Laws No. 144), the user consents to the provision of services by electronic means.

§9

Users who are registered on the website consent to the sending of information and communications (including promotional communications) via email and other means of communication (including telephone and telecommunications). A message sent is considered to have been effectively delivered.

§10

All prices of the products offered are gross prices.

IV. Registration

§1

After completing the registration form, the user gains full access to the educational and informational website, where they can also purchase paid courses, information packages, and related services. The user may modify their information at any time in the administration panel.

The registration process for paid services is confirmed and secured upon receipt of information from PayU or CoinPayment regarding the completed transaction.

§4

The website reserves the right to refuse to register a user or to sell them the products and services offered.

§5

In the event of a violation of these Terms of Service, the User’s access to their account may be blocked, either temporarily or permanently. Furthermore, in the event of a violation of these Terms of Service, the User may not assert any rights against the educational website jacekdudzic.pl

§6

A user may opt out of using the educational website at any time.

§7

The agreement is terminated when:

a. the User is in arrears with payments

b. the User’s name violates the applicable rules

c. the User fails to comply with the Terms of Service

d. at the Operator’s request

V. Rates

§1

The jacekdudzic.pl website reserves the right to change the classification of courses and the accompanying services

a. from free to paid

§2

Access to free and paid courses, information packages, and related services is granted by logging in to the website via a web browser. Users receive:

a. instructional materials along with user instructions

b. instructions for using the courses and informational materials

c. access to consultations with the authors (via private messages)

§3

A user who learns through a purchased course bears full responsibility for their learning outcomes—or lack thereof—and for any actions resulting from the knowledge gained.

§4

The Service reserves the right to discontinue providing services or to change its business model.

VI. User

§1

Users of jacekdudzic.pl may be individuals or companies who will use the resources of the jacekdudzic.pl informational and educational website, in particular:

a. who will take advantage of the free and paid courses offered,

b. who will participate in webinars, meetings, conferences, and other events organized by the jacekdudzic.pl informational and educational website

§2

The user is obligated to use the website in accordance with these terms and British law. The disclosure of personal data is done at the user’s own risk.

§3

The user is required to provide notification if there is a change in personal data or other types of information.

§4

The User is liable for any violation of these Terms of Service.

§5

The User’s rights and obligations may be transferred to third parties in writing.

The User may select courses and accompanying services, which they will pay for and be able to use. The current list of courses and price lists are available on the website.

VII. Warranty and Complaint Procedure

§1

Any suggestions regarding digital products and services should be submitted directly to jacekdudzic.pl via the contact form on the Contact page.

§2

Complaints regarding the Winyl ID service, as well as courses and informational materials, must be submitted to: . Complaints will be addressed within 7 business days at the latest.

§3

Security certificates are in use; therefore, the website is not liable for data transmission, including the processing of banking transactions.

§4

Pursuant to Article 27 of the Consumer Rights Act of May 30, 2014 (Journal of Laws of 2014, item 827), who has entered into a distance contract may withdraw from it within 14 days without giving any reason and without incurring any costs, except for the costs specified in Article 33, Article 34(2), and Article 35.

§5

The Consumer does not have the right to withdraw from a distance contract in respect of a contract where the subject matter of the performance consists of audio or video recordings or computer programs delivered in sealed packaging, if the packaging has been opened after delivery.

A student or Consumer wishing to obtain a refund should contact us at:

Refunds are processed by jacekdudzic.pl within 14 days of the request to the bank account specified by the Student or Consumer.

VIII. Payment Terms

§1

Users make payments through external payment processors: TPay, Stripe, and PayPal.

§2

Access to courses and services is granted once the payment has been processed.

§3

All prices are listed in Polish zlotys and include VAT. Shipping costs, which depend on the selected delivery method and payment method, are added to the price of physical products ordered (e.g., vinyl records).

§4

The store reserves the right to change the prices of the Products in its catalog, introduce new Products to the store’s catalog, and conduct promotional campaigns on the store’s website. This right does not affect the prices of Products in orders placed before the effective date of any price changes, promotional terms, or sales.

IX. Technical Matters

§1

The Operator is not liable for any errors or irregularities in internet transmission, nor for the consequences of sending incomplete data or information.

The data is processed for the purpose of providing Services (participation in training programs, purchase of training materials, participation in webinars, as well as in cases where it is necessary to fulfill the legitimate purposes of IMAGO Jacek Dudzic, as the Data Controller.

The Data Controller makes every effort to protect Users’ personal data from unauthorized access by third parties.

§6

The data referred to above is protected in accordance with applicable regulations using the best technical security measures; among other things, the server hosting the software is located in a secure, constantly monitored, and specially designated room. The data is stored and processed using secure mechanisms to protect the transmission of personal data. The transmission of personal data occurs via the SSL (Secure Socket Layer v3) protocol. This method involves the encryption and decryption of data between the client’s browser and the server. SSL encrypts, authenticates, and ensures the integrity of messages.

Data is stored on the servers of Multi Payments System LTD, Company Number 10434460, 2nd Floor, 40 Tooting High Street, Tooting Broadway, London, United Kingdom, SW17 0RG, with which the Website Owner has entered into a Data Processing Agreement

These Terms of Use may be amended at any time. The User will be notified of any amendments to the Terms of Use and the effective date of such amendments via Facebook messages (www.facebook.com/dudzicjacek). Unless otherwise specified in the announcement regarding the changes, amendments to these Terms and Conditions take effect 7 days after the date of publication.
